The website www.shopviarodeo.com (“Via Rodeo”, “Website”,"Site") is owned and operated by UAE Trading Company LLC, a limited liability company incorporated under the laws of the United Arab Emirates, with commercial license number 200429.  If you have any questions regarding this Website, these Terms and Conditions or in the rare unfortunate circumstance that you have any complaint you may contact our customer service team via any of the following methods:

These Terms and Conditions contain defined terms which are identifiable as they always start with a capital letter even when they are not in the beginning of the sentence.  Their meanings can be found where the defined terms are in parenthesis and quotes.

Where you see “we”, “us” or “our”, we mean UAE Trading Company.  Where you see “you” or “your” we mean you, the person using the services offered on www.shopviarodeo.com.

 

USE OF THE WEBSITE

All users agree that their access and use of services on the Website are made in accordance with the Terms and Conditions (“Terms”) set forth in this legal notice as well as in our Privacy Policy and applicable laws, and any such access or use is undertaken at the user’s own responsibility and consent.  The Website Policies and Terms & Conditions may be changed or updated occasionally to meet the requirements and standards. Therefore the Customers’ are encouraged to frequently visit these sections in order to be updated about the changes on the website. Modifications will be effective on the day they are posted.  If you do not agree to any Term or relevant change thereto, then you must cease using and accessing the Website.  If you continue to use it and/or place an order through the Website then you are deemed to have consented to the latest version of the Terms and Conditions posted at the time of your order as those will apply.  If there is a change in the law after you place an order but before you receive it, only then will we be obliged to apply that change in law to your order.

You agree that all information provided by you while placing an order is true and accurate in all respects and by placing an order you expressly authorize us to share your information with other companies for the purpose of processing your order (such as for payment processing and shipping). You agree to update your account with any change in your information (if any) or to notify our customer service team of any changes to that information.  Before using this Website please read our Privacy & Cookie Policy for information on how we use/share your data.

 

ELIGIBILITY TO PURCHASE AND REGISTRATION

You must be at least 18 years of age to place an order on this Site and you must provide us with your accurate personal details such as your first and last name, email address, shipping address, phone number and you will be required to provide payment details which you represent and warrant are accurate and belong to you.

The use of some of the services available on this Site such as creating and sharing a wish list, viewing your order history, receiving and using store credit, tracking your orders, placing a quick re-order and changing your personal account details, will require you to register for an account. Doing so is easy.  Simply click “REGISTER” on the top right side of the Site and it will direct you to a form for “NEW CUSTOMERS” where you will be required to enter in your first name, last name and email address.  You will have the option to subscribe to receive our news and promotions.  You will need to create a password and then click on “JOIN THE FAM”.  You will receive an email containing a link for you to click on to activate your account and that concludes the registration process.

In case you need to change any of the information you provided us with then you can log into your account and do this yourself or you can email us at [email protected] and we will do it for you.

In case you have forgotten your password, click the “Forgot your password?” link under the password field and you will be redirected to a page where you can enter your email address and a link to reset your password will be emailed to you.

By placing an order, you expressly authorize Via Rodeo to deduct the purchase price inclusive of any shipping, taxes &/or duty charges from the bank card/account you provide Us with after conducting all inspections deemed necessary by Via Rodeo including anti-fraud checks which require sharing your personal details with relevant agencies.

VIA RODEO reserves the right to reject any purchase for reasons including but not limited to the use of a non-valid credit/debit card or a card issued by a bank which is not acceptable to VIA ROOEO.

 

ORDERS

All orders are subject to acceptance and availability.  Items in your shopping bag are not on hold or reserved for you and they may be purchased by other customers unless/until such items are paid for by you.  When you place an order with us, you commit to buy the item/s described in that order at the price indicated including any delivery fees, taxes and duties where applicable.

Orders are subject to our acceptance, which we may withhold at our sole discretion including for reasons such as ineligibility, inability to confirm payment authorization, suspected fraud, shipping restrictions, stock unavailability and item/s failure to pass our quality control inspection.

We may occasionally refuse or cancel an order or suspend an account if we suspect illegal activity including, but not limited to, fraud.

We will not be liable to you or any third party by reason of our withdrawing any merchandise from the Site whether or not that merchandise has been sold, nor are we liable for removing, screening or editing any materials or content on the Site, refusing to process a transaction or suspending any transaction after processing has begun.

We cannot guarantee that an item stated to be available will actually be available right away as inventory can change significantly throughout the day.  In rare cases a product may be available when you place an order but sold out by the time we process the order.  Should this happen, we will notify you and you will not be charged.

At the time you place your order, your total amount is only pre-authorized (for a max of 5 days) and you will receive an Order Acknowledgment email from us.  This is not an Order Acceptance from us, but only a confirmation that we have received your order.  No party other than us has the authority to confirm acceptance of your order.  The item/s you ordered will be en-route to our packing/shipping facility where on arrival they will undergo a strict quality control inspection.  If you have not cancelled your order by the time your items pass the quality control inspection then you will receive an Order Confirmation email from us and will be charged for your order.  Once payment is successfully processed then your order has been accepted by us and you will be notified by receiving a 3rd email confirming dispatch of your ordered item/s which will also contain your tracking number.

If you are placing an order from within the UAE and have selected Cash on Delivery as your payment option then please note your order amount has to be paid in full before receiving the package and signing the delivery sheet, not after.  If you want to return the package you will need to notify us after payment to the courier and you will need to send us back the package at your own expense by following our normal returns procedure.

 

PRICING AND PAYMENT POLICY

Prices, delivery charges, applicable taxes and any other applicable fees can be seen on the Site in AED and USD depending on where you are viewing the site from or depending on which currency you select to view the Site in.  Should you wish to change the currency, you can do so by using the currency switcher located on the top right of the Site to switch between AED and USD.

For UAE orders, in addition to the price of the items you purchase, we also collect your delivery and tax charges.  International orders are shipped on a DDU basis so we will charge you for the items you purchase and their shipping costs but not your import duties or any relevant taxes as those will be invoiced to you by DHL or any import broker you appoint.  It is always best to contact your local customs authority to find out your landed cost before you place an order on our Site.

Prices are subject to change for a variety of different reasons, among them mark downs, currency exchange rates varying or any other commercial reason.  We will honor the price displayed at the time we accept your order.  You may pay with a foreign currency-denominated account but the payment will be taken in AED or USD (depending on what you select) and your card issuer will convert the AED or USD value using their foreign exchange rate at the time that your card issuer processes your transaction.

Aside from Store Credit, we accept the following forms of payment:
  • Domestic (within UAE) -  Visa, MasterCard & Cash on Delivery (COD).  Please note the limit for COD payments is 3,000 AED.
  • International (outside UAE) - Visa & Mastercard
Should your card issuer refuse to authorize payment, your order will be cancelled but you may be contacted for an alternative mode of payment.

By making a purchase via credit/debit card, you confirm that the same is yours or that you have been authorized by the owner of the card to use it on our Site for the total amount specified when you place your order.

We do not store, sell, lease or share card information to any third parties except our online payment gateway service provider.  All credit/debit card transactions on this Site are processed using the TELR secure platform which encrypts your card details in a secure host environment.

 

PROMOTIONAL CODES

Promotional codes (if any) are valid until the published date of expiry and may only be used on items as specified in each case.  Promo codes may not be redeemed for cash or credit nor combined with any other coupon or discount offer, nor are they valid on previous purchases.

 

SHIPPING/DELIVERY

Via Rodeo (www.shopviarodeo.com) will NOT deal or provide any services or products to any of the OFAC (Office of Foreign Assets Control) sanctions countries in accordance with the law of the UAE.

We have partnered with the follow companies for shipping/delivery:
  • Domestic (within UAE) - UPS & Empost
  • International (outside UAE) - UPS & DHL

Via Rodeo insures all your purchases from the time they are picked up to the time they are delivered to your address.  A signature is required for goods delivered at which point the responsibility of them passes to you.  In some circumstances, you may update your preference for DHL/UPS/Empost to deliver your package at an address without obtaining a signature and should that be what you set then you take full responsibility for any loss or damage which may occur to your package.  If you have detailed the receiver of the order as someone other than you, such is the case with gifts, then you accept that their signature or the signature of a person at the delivery address you have provided to us is evidence of our fulfillment of your order and we are no longer responsible after delivery to the address you have provided us with.

Our packing and shipping facility is open 5 days a week, Sunday through Thursday, from 8:30 am to 7 pm local Dubai time excluding national holidays.  Although they strive to get your order out within 3 working days, some carrier, logistic, clearance &/or weather delays may occur.  The delivery times appearing on the website are estimates and commence from the date of dispatch.  Via Rodeo is not responsible for any delays caused by destination customs clearing.

In a worst case scenario you should receive your order within 30 days from receiving your Order Confirmation from us.  Please get in touch with our customer service team via phone at +971 4 343 4040 or by email at [email protected] if your package is delayed beyond 15 business days and if you are unsatisfied with the information provided to you by DHL/UPS/Empost and we will be happy to assist you as best we can.  We could introduce an additional delivery method.

 

CANCELING YOUR ORDER

You can cancel your order for any reason after receiving your Order Acknowledgement and before receiving your Order Confirmation.  To do this please forward the Order Acknowledgement email you received from us to the customer service team at [email protected] and mention that you wish to cancel the order.  This will be done and you should see the funds back in your account within 14 business days.

 

RETURNING/REFUNDING YOUR ORDER

You can return items at your expense within 14 days of receiving them provided you email us a Return Request to [email protected] containing the following information and follow the procedure mentioned below:
  • Full name
  • Email used when placing order
  • Order number
  • Delivery address
  • Date received
  • Product reference number/s
  • Reason for return
  • Photo of the item/s you wish to return

Once approved we will email you return instructions along with a form containing a reference number which you will need to print out, sign and include inside your package to allow for easy identification and prompt processing once returned.  Unidentified returns will be sent back to the sender at their expense.  Please remove all labels from previous deliveries from the box you are using to send your items back to avoid delays.

Provided the above procedure has been followed, you will receive a full refund (excluding shipping, customs, clearing expenses) for the price of the item/s returned in store credit which will be redeemable against subsequent orders and will be valid for 365 days from the day issued.  If you made your purchase using the "Guest Checkout" rather than from your user account then we will set up a temporary account for you containing your store credit.  In order to access this temporary account you will need to click on "Register | Sign In" on the top right corner of the home page.  Next you will need to click on the "forgot your password?" link and enter in the same email address you used when placing your order.  A password reset email will be sent directly to your email address so you can gain access to your user account and can use your store credit.

All returns must be unused, unaltered and with all their original garments tags, dust covers and packaging intact.

Footwear should be tried on a carpeted surface so the soles don’t reflect them being worn.

Products which are not eligible for return or refund are as follows:

  • Undergarments
  • Swimwear with their hygiene sticker moved/removed
  • Beauty/Grooming products (perfumes, make up, nail polish, lotions, sprays, aerosol cans)
  • Books
  • Items bought on sale
  • Product/s not purchased from us
  • Items which are used, had their original tags removed &/or are not in their original packaging &/or missing their certificates of authenticity they were sent with &/or missing any additional items which were sent with the item (for example: extra shoe laces).

 

 

MANUFACTURING DEFECT

If you believe you have received an item with a manufacturing defect then please get in touch with us by phone (+971 4 343 4040) or email ([email protected]) and we will assist you in shipping the item back to us.  Returned items deemed to have a manufacturing defect will be either repaired or replaced and reshipped to you on a DDP basis (completely free of charge) and if neither repair nor replacement is possible then you will receive a full refund including all shipping expenses you paid to the same account you paid from within 14 business days (depending on the processing bank’s lead time) or you can choose to receive the amount in store credit (valid for 365 days) within 7 working days if you prefer that.

Please note that it is never a good idea to attempt to destroy an item to make it look as though it has a manufacturing defect as our product experts will easily identify this and your return request will be denied, the items you destroyed will be sent back to you and your account on the Site will be disabled so you will not be able to make future purchases.  Misusing an item &/or failing to follow care instructions (including washing instructions) does not constitute a manufacturing defect.

 

INTELLECTUAL PROPERTY RIGHTS

Using this Site does not grant you any rights associated with any registered or unregistered trademark, trade name, brand, logo, domain name, copyright, design, software and other content/code/IP owned by VIA RODEO or by third parties.  Reproduction or redistribution of the above-mentioned content may result in civil and criminal penalties.  By “content” we mean graphics, photographs, sound, audio or text on this Site.

 

FURTHER DISCLAIMERS

Although we endeavor to keep VIA RODEO error-free, we assume no liability for errors or omissions on the Site and we cannot guarantee that the content or functional aspects of the Website are error free, nor can we ensure that the servers which host it are free of viruses or any other harmful components.  We are not liable for any loss or damage caused by a distributed denial-of-service attack, viruses or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of the Site or any website linked to it including unauthorized third party access to any data you provide when accessing or ordering from the Website.

We may provide hyperlinks to third-party websites for your convenience.  The inclusion of such link/s does not imply our endorsement of that website or its owner/s nor are we held liable for any damage that may occur from your use thereof.

VIA RODEO does not necessarily share the views of brand owners, designers and third parties with whom it is associated and hence we accept no liability for any such views however expressed.

Due to monitor differences, product colors may vary from what appears online and hence we cannot be liable for such color variances.

 

NO COMMERCIAL USE

This Site is for personal non-commercial use only.  Do not modify, copy, reproduce, publish, commercially exploit or reproduce any content, software or element from it to further any commercial or revenue generating purpose.

 

NO WARRANTY

We make no warranty, representation, or any promise and offer no other conditions, regarding any matter, including, without limitation, the merchantability, suitability, fitness for a particular use or purpose, or non-infringement of Website membership, any content, or any products purchased through the Website unless stipulated in these Terms or required by applicable law.

By electing to use the Website, you have accepted that it is provided on an "as is" and "as available" basis.  Any advice or information that you may obtain from the Website or from our customer service representatives over the phone or email shall not create any warranty.  We may restrict or terminate your access to the Website any time at our sole discretion.  We make no further warranties that access to the Website will be uninterrupted, error-free, or secure; that the Website or the server that makes the Site available will be virus-free; or that information on the Site will be correct, accurate, adequate, complete, useful, timely, or reliable unless required by applicable law.  You will be solely responsible for any damage to your computer or loss of data that results from the download of any content from the Website.

 

LIABILITY

We will update the Website from time to time although we aren’t obliged to do so which means that information could be outdated at any given time.  The information provided is not for advice purposes to be relied on but for general information purposes only. We make no representations, guarantees or warranties that the website and/or its contents are free from errors or omissions.

NO WAIVER

No failure or delay on the part of VIA RODEO to enforce any of its rights provided for in these Terms or any other rules, laws or policies shall be construed as a waiver of such rights.

 

RIGHT TO VARY TERMS

We retain the right to vary these Terms any time at our sole discretion and without notice.

 

NO AGENCY

Nothing contained in these Terms shall be construed as creating any agency, partnership, or other form of joint enterprise between us.

 

ILLEGALITY

If any part of these Terms is deemed unenforceable then the rest of the Terms still remain in full effect.

 

DISPUTES AND GOVERNING LAW

Anything related to your use of the Site, these Terms and Conditions or your order/s are governed by UAE law and the courts of the United Arab Emirates have the exclusive jurisdiction over any dispute/claim.
